2. Scope of Application                 

The business relationship between Germinal GmbH and the purchaser shall be governed exclusively by the standard terms and conditions of business in effect at the time of the order.


3. Order

Please feel free to browse our range of products at your leisure. If you see something of interest, place the product in your virtual shopping basket by clicking on the virtual shopping basket symbol located next to the product.

You can initiate the order process by clicking on the “Go to checkout? button. This will display the products that you have placed in your shopping basket. You have the option here to remove products from the shopping basket. Here you will receive an overview of all products that are currently in your shopping basket as well as all costs associated with your order.

Before confirming your order by clicking on the “Confirm payment? button, you have the option to amend your details by clicking on the “Update quantity? or “Remove item from “shopping basket? buttons.  To amend the order quantity, enter the correct figure in the relevant field and click on “Update quantity?. To delete the item, click on the cross on the right (= remove item from shopping basket).

Upon pressing the “Confirm payment? button your order will be created and sent to us. Upon placement of your order you enter a binding agreement to purchase the goods.


4. Conclusion of contract

Upon placing an order you enter a binding agreement with Germinal Verlags-und Medienhandlung GmbH. For electronic orders you will receive an “Order confirmation via email upon placement of your order. The order confirmation is an automated response and does not constitute acceptance of the contract.

The contract with Germinal GmbH comes into effect upon dispatch of the goods ordered by you.

The contract language is German.


5. Reservation of non-availability

We reserve the right to refrain from processing an order if we do not have the title ordered in stock, or the title is out of print and can no longer be supplied. In this event we will inform you of the unavailability and refund you the purchase price paid.


6. Prices and Delivery Charges                  

The prices provided by Germinal GmbH are final prices in euros and include VAT.

Germinal charges EUR 3.00 for postage and packaging within Germany. There are no postal charges within Germany for order values over EUR 25.00.

The following postage costs apply for overseas orders:

Deliveries to Belgium, Denmark, France, Great Britain, Italy, Luxembourg, the Netherlands, Austria and the Czech Republic cost €8.00.

Deliveries to all other EU member states will be charged at €12.00.

Deliveries to Switzerland, Liechtenstein or Norway will be charged at €15.00.

Deliveries to all other countries are charged at €25.00.

We deliver by post, DHL or DPD.


      7. Terms and conditions of payment

The purchase price is due without deduction within 14 days of the issue of the invoice.

Accepted payment methods are credit card, PayPal or bank transfer.

On the expiry of the above period, the purchaser shall be in default of payment.

In this case, Germinal GmbH has the right to charge default interest in the amount of 5 per centum above the base rate of the German Federal bank as published at the relevant time.

This shall not affect the right to claim any further losses in respect of the delayed payment.


8. Delivery                          

Germinal GmbH shall make immediate delivery, at the latest, however, 5 days after receipt of your order. Binding delivery dates must be agreed in writing. The deadline for delivery shall be deemed to have been complied with if the goods are dispatched prior to the expiry of the delivery deadline.


9. Reservation of proprietary rights

The terms and conditions of payment and delivery of Germinal GmbH are deemed to be accepted upon unqualified acceptance of the consignment.

Germinal GmbH retains its ownership of the delivered goods until payment in full of all amounts receivable from the purchaser.


     10. Warranty

Statutory warranty regulations shall apply.


     11. Applicable law and jurisdiction.

The law of the Federal Republic of Germany shall apply with the exclusion of the UN International Trade Law.

If the person placing the order is a businessman or legal person under public law, the place of jurisdiction for all legal disputes relating to this contract is the court of our company location in Fernwald.

     DATA PROTECTION              

                The collection, processing and use of personal data shall only take place to the extent that it is necessary to fulfil the customer’s order and in accordance with the principles of data avoidance and minimization.

The data shall be collected in order to properly deal with the order process including delivery and the settlement of accounts. By dispatching his order, the customer declares that he agrees that the personal data transmitted may be processed as part of the above order processing, delivery and settlement of accounts.

Personal data shall only be transmitted to third parties with the prior consent of the customer. The customer declares that he agrees that his personal data may be transmitted to a debt collection agency which is obliged to observe data protection provisions to the same extent.

So-called cookies are used on various pages across our website. These are small text files that are saved to your device. Cancellation of an order for printed books and other physical goods


Consumers are entitled to a legal right of cancellation. A consumer is any natural person that enters into a legal transaction, that is assigned neither to a business or independent professional activity (§13 BGB).



Right to cancellation

You have the right to cancel this contract within 14 days without providing any reasons.

The cancellation period begins 14 days from the date that you, or a third party named by you that is not the carrier, have received all goods at your location.

To exercise your cancellation right you must inform us of your decision to cancel this contract by sending us clear notification of this (e.g. letter by post, fax or email) to:

You may use the sample form provided, however this is not mandatory.

In order for the cancellation to be valid, your notification of cancellation must reach us before expiry of the cancellation period.


Consequences of cancellation

Upon cancellation of this contract, all payments that we have received from you - including for delivery costs (with the exception of additional costs incurred as a result of using a delivery method other than the standard economy delivery chosen by us) – shall be refunded within 14 days from the date of receipt of the cancellation request. We use the same payment method for refunds as for the original transaction unless otherwise expressly agreed; under no circumstances will compensation be paid as a result of this refund.

We may refuse to process a refund request until we have received the goods or until you provide proof that the goods have been despatched to us, whichever we receive first.

The goods must be returned or despatched to us within 14 days from the date of cancellation. The deadline shall be deemed met provided the goods are despatched to us within 14 days. The return costs shall by borne by you.

You shall be liable for any diminished value of the goods if, upon inspection of the condition, properties and functionality of the goods, this loss is found to be a result of your handling the goods in an improper manner.

Premature expiration of the right of cancellation:

The right of cancellation does not apply to deliveries of audio or video goods (e.g. CD, music or video tapes) or for computer software that has been removed from its original sealed packaging.

Furthermore, the right of cancellation does not apply to goods that have been pre-packaged and customised or tailored to individual customer requirements.

The right of cancellation furthermore does not apply to the delivery of newspapers, magazines or journals, with the exception of subscription contracts.
